The Fair Work Act has been the subject of a great deal of attention since the election of the Albanese Government in terms of both changes that have occurred to date and proposals for further change in the latter part of 2023.  This workshop will provide an update on the responsibilities of employers arising from changes and how future proposals might affect the group training and labour hire sector.

Secure Jobs Better Pay legislation received assent on 6 December 2022 and includes:

• Fixed term contracts
• Termination of zombie agreements
• Pay secrecy clauses
• Flexible work requests
• Parental leave flexibility
• Prohibition on sexual harassment
• Prohibition on job ads that breach the Fair Work Act

Protecting Worker entitlements legislation received assent on 30 June 2023 and includes:

• Inserting superannuation in the National Employment Standards
• Providing stronger access to unpaid parental leave to assist families to share work and care responsibilities
• Making pay deductions for authorised purposes an easier process for workers and businesses

Proposed workplace reforms legislation subject to current consultation and includes:

• Stand up for casual workers – who is a casual?
• Closing labour hire loopholes
• Compliance and enforcement: Criminalising wage theft
• Provide stronger protections against discrimination, adverse action and harassment
• A single national framework for labour hire regulation, which could be implemented in place of existing state and territory schemes
